Education Enhancement Reserve Joint Powers Authority Agreement Background

In 2005, the Shoreline Regional Park Community Tax District (Shoreline Park District) entered into the Education Enhancement Reserve Joint Powers Authority (EER JPA) agreement with the Mountain View Los Altos High Union School District (MVLA) and Mountain View Whisman School District (MVWSD) to make direct payments from the Shoreline Park District to the school districts. The EER JPA was created recognizing that both the Shoreline Park District and the School Districts benefit from quality educational programs as a way of attracting and retaining major industries into the Shoreline Community.

The initial funding was $400,000 per year per District and has grown considerably over time. The agreement has been amended and replaced several times since its adoption. In 2019, the agreement was amended to provide the School Districts with their full tax rate allocation on property tax revenue from new residential development in the Shoreline Community, recognizing that new housing in the Shoreline Community will result in increased school enrollment. This provision gives the Districts a larger share of the tax revenue that would otherwise go to the Shoreline Park District.

Since 2005, the Shoreline Park District has paid a total of $55,074,817 to MVWSD and $36,191,659 to MVLA which is more than $91 million combined.

Current Short-Term Agreement

The current EER JPA agreement was adopted in June 2023 and will lapse in June 2024. Under this agreement, MVWSD will receive approximately $6.4 million and MVLA will receive approximately $4.3 million for the 2023-24 Fiscal Year.

The purpose of the agreement is to provide for the sound and economic growth of the Shoreline Park District through the improvement, rehabilitation, development, or redevelopment of school facilities that serve the residents of the area and the enhancement of technological education for students.

Successor Agreement

The Shoreline Park District and the School Districts are in the process of negotiating asuccessor agreement. The new agreement will continue payments to the School Districts while meeting the obligations and fulfilling the statutory purpose of the Shoreline Park District.

The obligations of the Shoreline Park District include:

  • Maintaining, operating, and administering the 750-acre Shoreline at Mountain View Regional Park;
  • Preserving and enhancing extensive wetlands and irrigated meadowlands that are home to Federally protected species;
  • Maintaining and improving a system of tidal marshes, sloughs, creeks, and a storm retention basin to provide sea level rise flood protections;
  • Maintaining, improving and ensuring regulatory compliance to address environmental risks associated with a 650-acre closed regional landfill;
  • Providing needed additions to the general housing supply;
  • Providing opportunities for innovation in housing and community development technology and land use planning;
  • Installing, replacing, and upgrading transportation infrastructure, including streets, sidewalks, and other projects to support the development of complete neighborhoods, enable active transportation, and address traffic congestion in the North Bayshore Area; and
  • Installing, replacing and upgrading utilities, including water, sewer, stormwater, and recycled water infrastructure.

Joint Powers Agreement Board

The agreement also established a governing Board of Directors to administer the payments. The Board consists of:

  • Kimbra McCarthy, Community Manager, Shoreline Regional Park Community
  • Nellie Meyer, Superintendent, Mountain View Los Altos High School District 
  • Ayindé Rudolph, Superintendent, Mountain View Whisman School District

Meetings

Regular EER JPA Board meetings are held annually in November. Special meetings are scheduled as needed.
