State Law and Emergency Shelter Amendment

    Emergency Shelter Code Update March 2024

    Housing Element was adopted in April 2023 and includes a list of implementation programs to further the City’s housing goals and meet the State’s housing laws. One law, Assembly Bill 2339 (effective January 1, 2023) requires cities to identify zoning designations where emergency shelters are permitted uses by right (without a conditional use permit or other discretionary permits).  

     

    To comply with this mandate, the City has included in the Housing Element a program to update the El Camino Real Precise Plan to allow emergency shelters and to amend the existing development standards for emergency shelters to ensure compliance with State requirements.

    No emergency shelters are proposed at this time. Per State Law, the City has conducted a site analysis to study if there are viable sites to locate a shelter should one be proposed.

    This project is tentatively scheduled for the following upcoming public meetings:

    • City Council Tentatively Scheduled for March 26, 2024Meeting agenda, staff report and materials will be posted at mountainview.legistar.com the Friday prior to the public hearing date and will include information on meeting location, format, and how to participate. 

    Prior Meetings

    The following prior meetings have occurred: 

    • Environmental Planning Commission Public Hearing on February 21, 2024 At the meeting, EPC supported staff recommendation to take a phased approach of updating El Camino Real Precise Plan.
