Any party to a petition (both landlords and tenants) can file an appeal request to object to a petition decision, in whole or in part. Parties have 10 calendar days to file the request with the Rental Housing Committee (RHC) through the Rent Stabilization Program and serve it on all other applicable parties. If no appeals are filed within 10 calendar days, the decision is final.

General information on appeals as well as necessary forms are provided below. Contact program staff at MVRent@mountainview.gov or 650-903-6136 for help.

The appeal process:

  • Any party to a petition completes and submits an appeal request form to the Rent Stabilization Program.
  • They also provide (serve) the completed appeal form on the other party(ies) to the petitions.  
  • The appeal request is either accepted or denied by the Rental Housing Committee (RHC).
  • An appeal hearing is schedule before the Committee during a regularly occurring Rental Housing Committee meeting.
  • The RHC (typically) issues a Tentative Appeal Decision 14 days before the Hearing.
    • Both parties can respond to the Tentative Appeal Decision.
  • The Appeal Hearing is held before the RHC.
    • Both parties can (but are not required to) present their arguments and rebuttals to the RHC during the public hearing.
  • The RHC affirms, denies or remands all or a portion of the Tentative Appeal Decision. 
    • If the Tentative Appeal Decision is affirmed or denied (in whole or in part), the Decision is considered final and is not able to be appealed. 
    •  If the decision is remanded, the hearing officer addresses the remanded portion of the Tentative Appeal Decision and issues a new decision to the parties. 
    • Parties can appeal the remanded decision to the RHC.
